This document (together with other mentioned documents) regulates the conditions that govern the use of this Website (www.blautic.com) and the purchase or acquisition of products and/or services through it (hereinafter, the “Conditions”).

The User must also read the Legal Notice and the General Terms of Use, including the Cookie Policy, as well as the Privacy and Data Protection Policy of Blautic before using this Website or making any purchase and/or request for the acquisition of a product and/or service through it. If the User does not agree with any part of this, they should refrain from using this Website.

Additionally, it is noted that these Conditions may be subject to modifications. The User is responsible for reviewing them each time they access, browse, and/or use the Website, as the Conditions in force at the time of requesting the purchase of products and/or services will apply.

THE USER

Accessing, browsing, and using the Website grants the User the status of user (hereinafter referred to individually as “User” or collectively as “Users”), and implies the full acceptance of all the Conditions set forth herein and any subsequent modifications, without prejudice to compliance with the corresponding legal regulations, as applicable.

The User is responsible for using the Website correctly. This responsibility extends to:

• Using this Website solely for legitimate and valid consultations, purchases, or acquisitions.
• Not engaging in any false or fraudulent purchases. If it is reasonably considered that such a purchase has been made, it may be canceled, and the relevant authorities will be informed.
• Providing truthful and lawful contact information, such as email address, postal address, and/or other details (see Legal Notice and General Terms of Use).

PURCHASE PROCESS

Users can make purchases on the Website through the established means and methods. They must follow the online purchase and/or acquisition procedure on www.blautic.com, during which various products and/or services may be selected and added to the shopping cart or final purchasing space. Finally, the User should click on “Place Order.”

During the purchase process, the User must provide and/or verify the requested information. However, before making the payment, the User may modify the purchase details.

Once the purchase process is complete, the User consents to the generation of an electronic invoice by the Website, which will be sent to the User via email. The User may also request a paper copy of the invoice from Blautic using the contact information provided above.

The User acknowledges being aware, at the time of purchase, of specific terms of sale related to the product and/or service in question, which are displayed alongside its presentation or image on the Website. The User accepts and fully complies with the particular terms of sale applicable to each case upon placing the purchase order.

The communications, purchase orders, and payments made during transactions on the Website may be archived and stored in Blautic’s computerized records. This is intended to constitute evidence of transactions, subject to reasonable security conditions and compliance with applicable laws and regulations, particularly the General Data Protection Regulation (GDPR) and Organic Law 3/2018, of December 5, on Personal Data Protection and guarantee of digital rights, and the rights granted to Users in accordance with the privacy policy of this Website.

AVAILABILITY

All purchase orders received by Blautic through the Website are subject to product availability and the absence of any force majeure circumstances (clause nine of these Conditions) affecting the supply and/or provision of services. If there are any difficulties in supplying products or if products are out of stock, Blautic commits to contacting the User and refunding any amount paid for the purchase. This will also apply in cases where the provision of a service becomes unfeasible.

PRICES AND PAYMENT

The prices displayed on the Website are final prices in Euros (€) and include taxes unless specifically stated otherwise due to legal requirements, especially regarding VAT.

Shipping costs are included in the final prices of the products, as shown on the Website. Therefore, the Website will not automatically add any additional costs to the price of a product or service, only those explicitly selected and voluntarily chosen by the User.

Prices may change at any time, but such changes will not affect orders or purchases for which the User has already received an order confirmation.

Accepted payment methods are credit or debit cards. Blautic ensures the confidentiality and security of payment data transmitted by the User during transactions on the Website through a secure SSL (Secure Socket Layer) payment system.

Credit cards are subject to verification and authorization by the issuing bank. If the bank does not authorize payment, Blautic will not be responsible for any delays or failure to deliver, and no contract will be formalized with the User.

Upon clicking “Place Order,” the User confirms that the payment method used belongs to them.

RETURNS

In cases where the User purchases products through the website, they have certain rights regarding returns, as listed and described below:

Si por algún motivo, que le fuera imputable, Blautic no pudiera cumplir con la fecha de entrega, contactará al Usuario para informarle de esta circunstancia y, éste podrá elegir seguir adelante con la compra estableciendo una nueva fecha de entrega o bien anular el pedido con el reembolso total del precio pagado. En cualquier caso, las entregas a domicilio se realizan en días laborables.

Si resultara imposible efectuar la entrega del pedido por ausencia del Usuario, el pedido podría ser devuelto al almacén. No obstante, el transportista dejaría un aviso explicando dónde se encuentra el pedido y cómo hacer para que sea entregado de nuevo.

Si el Usuario no va a estar en el lugar de entrega en la franja horaria convenida, debe ponerse en contacto con Blautic para convenir la entrega otro día.

En caso de que transcurran 30 días desde que su pedido esté disponible para su entrega, y no haya sido entregado por causa no imputable a Blautic, Blautic entenderá que el Usuario desea desistir del contrato y éste se considerará resuelto. Como consecuencia de la resolución del contrato, todos los pagos recibidos del Usuario le serán devueltos, a excepción de los gastos adicionales resultantes de la elección propia del Usuario de una modalidad de entrega diferente a la modalidad menos costosa de entrega ordinaria que ofrece el Sitio Web, sin ninguna demora indebida y, en cualquier caso, en el plazo máximo de 14 días naturales desde la fecha en que se considera resuelto el contrato.

No obstante, el Usuario debe tener presente que el transporte derivado de la resolución puede tener un coste adicional que le podrá ser repercutido.

A efectos de las presentes Condiciones, se entenderá que se ha producido la entrega o que el pedido ha sido entregado en el momento en el que el Usuario o un tercero indicado por el Usuario adquiera la posesión material de los productos, lo que se acreditará mediante la firma de la recepción del pedido en la dirección de entrega convenida.

Los riesgos que de los productos se pudieran derivar serán a cargo del Usuario a partir del momento de su entrega. El Usuario adquiere la propiedad de los productos cuando Blautic recibe el pago completo de todas las cantidades debidas en relación a la compra o adquisición efectuada, incluidos los gastos de envío, o bien en el momento de la entrega, si ésta tiene lugar en un momento posterior a la recepción completa del importe objeto de pago por Blautic.

De conformidad con lo dispuesto en la Ley 37/1992, de 28 de diciembre, del Impuesto sobre el Valor Añadido (IVA), los pedidos de compra para su entrega y/o prestación se entenderán localizados en el territorio de aplicación del IVA español si la dirección de entrega está en territorio español salvo Canarias, Ceuta y Melilla. El tipo de IVA aplicable será el legalmente vigente en cada momento en función del artículo concreto de que se trate.

TECHNICAL MEANS TO CORRECT ERRORS

Users are informed that in case they detect an error when entering data necessary to process their purchase request on the Website, they can modify such data by contacting Blautic through the contact spaces enabled on the Website, and, if applicable, through those spaces enabled to contact customer service, or by using the contact details provided in the first clause (General Information). Additionally, Users can correct this information through their personal space on the Website.

Before clicking on “Place Order,” Users have access to their cart or basket where their purchase requests are listed, and they can make modifications.

Furthermore, Users are directed to consult the Legal Notice and General Conditions of Use, and specifically the Privacy Policy, to obtain more information on how to exercise their right of rectification as established in Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, concerning the protection of natural persons with regard to the processing of personal data and the free movement of such data (GDPR) and Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights.

RETURNS

In cases where the User purchases products through the website, they have certain rights regarding returns, as listed and described below:

Right of Withdrawal

As a consumer and user, you have the right to withdraw from your purchase on the website within 14 natural days without the need for justification.

This withdrawal period will expire after 14 natural days from the day you, or a third party authorized by you (other than the carrier), acquired physical possession of the purchased goods from the Blautic website. In the case of multiple goods ordered together but delivered separately, the withdrawal period starts from the day you, or a third party authorized by you (other than the carrier), acquired physical possession of the last item.

To exercise your right of withdrawal, you must notify Blautic of your decision. You can do so by using the contact spaces provided on the website.

You can also use the withdrawal form available on the website, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Upon withdrawal, Blautic will refund all payments received from you, including delivery costs (except for any additional costs arising from your choice of a different delivery method than the least expensive standard delivery offered on the website). The refund will be made without undue delay and, in any event, no later than 14 natural days from the date Blautic is informed of your decision to withdraw.

Blautic will make the refund using the same payment method you used for the initial transaction, unless you have expressly agreed otherwise. The refund will not incur any additional fees.

You must return the products to Blautic at the following address: Paseo Facultades, 1, bajo dcha, 46021, Valencia, Spain, without undue delay and, in any event, no later than 14 natural days from the date you informed Blautic of your decision to withdraw.

Y deberá hacerlo sin ninguna demora indebida y, en cualquier caso, a más tardar en el plazo de 14 días naturales a partir de la fecha en que Blautic fue informado de la decisión de desistimiento.

El Usuario reconoce conocer que deberá asumir el coste directo de devolución (transporte, entrega) de los bienes, si se incurriera en alguno. Además, será responsable de la disminución de valor de los productos resultante de una manipulación distinta a la necesaria para establecer la naturaleza, las características y el funcionamiento de los bienes.

El Usuario reconoce saber que existen excepciones al derecho de desistimiento, tal y como se recoge en el artículo 103 del Real Decreto Legislativo 1/2007, de 16 de noviembre, por el que se aprueba el texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios y otras leyes complementarias. De forma enunciativa, y no exhaustiva, este sería el caso de: productos personalizados; productos que puedan deteriorarse o caducar con rapidez; CDs/DVD de música o video sin su envoltorio, tal y como se precinta en fábrica; productos que por razones de higiene o de la salud van precintados y han sido desprecintados tras la entrega.

En este mismo sentido se rige la prestación de un servicio que el Usuario pudiera contratar en este Sitio Web, pues esta misma Ley establece que no asistirá el Derecho de desistimiento a los Usuarios cuando la prestación del servicio ha sido completamente ejecutada, o cuando haya comenzado, con el consentimiento expreso del consumidor y usuario y con el reconocimiento por su parte de que es consciente de que, una vez que el contrato haya sido completamente ejecutado por Blautic, habrá perdido su derecho de desistimiento.

En todo caso, no se hará ningún reembolso si el producto ha sido usado más allá de la mera apertura del mismo, de productos que no estén en las mismas condiciones en las que se entregaron o que hayan sufrido algún daño tras la entrega.

Asimismo, se debe devolver los productos usando o incluyendo todos sus envoltorios originales, las instrucciones y demás documentos que en su caso los acompañen, además de una copia de la factura de compra.

Return of Defective Products or Wrong Delivery
Se trata de todos aquellos casos en los que el Usuario considera que, en el momento de la entrega, el producto no se ajusta a lo estipulado en el contrato o pedido de compra, y que, por tanto, deberá ponerse en contacto con Blautic inmediatamente y hacerle saber la disconformidad existente (defecto/error) por los mismos medios o utilizando los datos de contacto que se facilitan en el apartado anterior (Derecho de Desistimiento).

El Usuario será entonces informado sobre cómo proceder a la devolución de los productos, y estos, una vez devueltos, serán examinados y se informará al Usuario, dentro de un plazo razonable, si procede el reembolso o, en su caso, la sustitución del mismo.

El reembolso o la sustitución del producto se efectuará lo antes posible y, en cualquier caso, dentro de los 14 días siguientes a la fecha en la que le enviemos un correo electrónico confirmando que procede el reembolso o la sustitución del artículo no conforme.

El importe abonado por aquellos productos que sean devueltos a causa de algún defecto, cuando realmente exista, será reembolsado íntegramente, incluidos los gastos de entrega y los costes en que hubiera podido incurrir el Usuario para realizar la devolución. El reembolso se efectuará por el mismo medio de pago que el Usuario utilizó para pagar la compra.

En todo caso, se estará siempre a los derechos reconocidos en la legislación vigente en cada momento para el Usuario, en tanto que consumidor y usuario.

Warranties

As a consumer and user, you have warranty rights for the products you purchase through the website, as established by the relevant legislation for each type of product. Blautic is liable for any lack of conformity that becomes apparent within two years from the delivery of the product.

The products will be considered in conformity with the contract if they meet the description provided by Blautic, possess the qualities presented in the description, are fit for the ordinary purposes for which such products are used, and exhibit the usual quality and performance of products of the same type.

If a product does not conform to the contract, you should proceed as indicated in the Return of Defective Products or Wrong Delivery section above.

Please note that some products may have non-homogeneous characteristics due to the nature of the materials used, which are considered part of the individual appearance of the product and not a defect.

If you purchase a product from a third-party brand or manufacturer through the website and consider it to be defective, you may also contact the brand or manufacturer directly to exercise your warranty rights within two years from the delivery of the product.

DISCLAIMER OF LIABILITY

Unless otherwise provided by law, Blautic will not accept any responsibility for the following losses, regardless of their origin:

• Any losses not attributable to any breach on their part.
• Business losses, including loss of profit, revenue, contracts, anticipated savings, data, loss of goodwill, or any other economic loss.
• Any other indirect loss that was not reasonably foreseeable by both parties at the time the sales contract was formed.

Similarly, Blautic also limits its liability in the following cases:

• Blautic takes all necessary measures to provide an accurate display of the products on the website. However, they are not responsible for minimal differences or inaccuracies that may exist due to the screen resolution, browser issues, or similar factors.
• Blautic will act with the utmost diligence to make the product available to the carrier for delivery. However, they are not liable for damages resulting from transportation malfunctions, particularly due to reasons such as strikes, road closures, and other circumstances common in the sector that lead to delays, losses, or theft of the product.
• Technical failures that prevent the normal operation of the internet service due to fortuitous events or other reasons. Also, the lack of website availability due to maintenance or other reasons that prevent the use of the service. Blautic makes every reasonable effort to ensure a smooth purchasing, payment, and shipping/delivery process for products, but they are exempt from liability for reasons beyond their control, such as force majeure.
• Blautic will not be held responsible for the misuse and/or wear of products used by the User. Additionally, Blautic will not be responsible for any incorrect returns made by the User. It is the User’s responsibility to return the correct product.

In general, Blautic will not be held liable for any non-compliance or delay in fulfilling any of its obligations when such non-compliance or delay is due to events beyond its reasonable control. This includes events of force majeure, which may include, but are not limited to:

• Strikes, lockouts, or other labor disputes.
• Civil unrest, riots, invasion, terrorist threats or attacks, declared or undeclared war, or war preparations.
• Fires, explosions, storms, floods, earthquakes, collapses, epidemics, or any other natural disasters.
• Inability to use trains, ships, planes, motor vehicles, or other means of public or private transport.
• Inability to use public or private telecommunications systems.
• Acts, decrees, legislation, regulations, or restrictions by any government or public authority.

In such cases, the obligations will be suspended for the duration of the force majeure event, and Blautic will have an extension period equal to the duration of the force majeure to fulfill its obligations. Blautic will make every reasonable effort to find a solution that allows it to fulfill its obligations despite the force majeure event.

WRITTEN COMMUNICATIONS AND NOTIFICATIONS

By using this website, the User agrees that most communications with Blautic will be electronic (email or notices posted on the website).

For contractual purposes, the User consents to receive communications from Blautic electronically and acknowledges that all contracts, notices, information, and other communications provided by Blautic electronically comply with legal requirements to be in writing. This condition does not affect the User’s statutory rights.

The User can send notifications and/or communicate with Blautic using the contact details provided in these Terms and Conditions and, where applicable, through the website’s contact spaces.

Likewise, unless otherwise stipulated, Blautic may contact and/or notify the User through their email or provided postal address.

DISCLAIMER OF LIABILITY

Ninguna renuncia de Blautic a un derecho o acción legal concreta o la falta de requerimiento por Blautic del cumplimiento estricto por el Usuario de alguna de sus obligaciones supondrá, ni una renuncia a otros derechos o acciones derivados de un contrato o de las Condiciones, ni exonerará al Usuario del cumplimiento de sus obligaciones.

Ninguna renuncia de Blautic a alguna de las presentes Condiciones o a los derechos o acciones derivados de un contrato surtirá efecto, a no ser que se establezca expresamente que es una renuncia y se formalice y se le comunique al Usuario por escrito.

WAIVER

No failure or delay by Blautic in exercising any specific legal right or requirement or no demand by Blautic for strict compliance by the User with any of its obligations shall constitute, or be construed as, a waiver of other rights or actions arising from a contract or these Conditions, nor shall it relieve the User of the fulfillment of its obligations.

No waiver by Blautic of any of these Terms or of the rights or actions arising from a contract shall be effective unless it is expressly stated to be a waiver and is formalized and communicated to the User in writing.

SEVERABILITY

If any of these Conditions is declared null and void by a definitive resolution issued by a competent authority, the remaining clauses shall remain in force and shall not be affected by said declaration of nullity.

ENTIRE AGREEMENT

These Terms and any document expressly referred to herein constitute the entire agreement between the User and Blautic regarding the subject matter of the sales contract and supersede any other agreement or promise, whether oral or written, between the parties.

The User and Blautic acknowledge that they have consented to the contract without relying on any statement or promise made by the other party unless expressly stated in these Terms.

DATA PROTECTION

The personal information or data that the User provides to Blautic during a transaction on the website will be processed in accordance with the Privacy Policy or data protection (contained, if applicable, in the Legal Notice and General Conditions of Use). By accessing, browsing, and/or using the website, the User consents to the processing of such information and data and declares that all information or data provided are truthful.

APPLICABLE LAW AND JURISDICTION

Access, navigation, and/or use of this website and contracts for the purchase of products through it shall be governed by Spanish law.

Any controversy, problem, or disagreement arising from or related to access, navigation, and/or use of the website, or the interpretation and execution of these Terms, or the sales contracts between Blautic and the User, shall be submitted to the non-exclusive jurisdiction of the Spanish courts and tribunals.

COMPLAINTS AND CLAIMS

Additionally, Blautic has official complaint forms available to consumers and users, which they can request from Blautic at any time using the contact details provided at the beginning of these Terms and Conditions (General Information).

Furthermore, if a dispute arises from this sales contract between Blautic and the User, the User, as a consumer, can request an out-of-court resolution of the dispute in accordance with Regulation (EU) 524/2013 of the European Parliament and of the Council of May 21, 2013, on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC.
